User Obligations

When using our services, you agree to:

• Use our services only for lawful business purposes

Account Responsibilities

Whilst we strive to provide uninterrupted service, cyberhubvexison does not guarantee that our services will be available at all times. We may temporarily suspend or restrict access to our services for maintenance, updates, or other operational reasons. We will endeavour to provide reasonable notice of planned maintenance.

Intellectual Property

All content, software, technology, and materials provided through our services, including but not limited to analytics algorithms, dashboard interfaces, reports, and documentation, are the intellectual property of cyberhubvexison Ltd or our licensors. This includes:

• Proprietary analytics algorithms and methodologies
• Dashboard designs and user interfaces
• Software code and technical implementations
• Documentation, guides, and training materials
• Trademarks, logos, and branding elements

You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of our software, unless laws prohibit those restrictions or you have our written permission.

Data and Privacy

For analytics services, you retain ownership of your business data. cyberhubvexison will process and analyse your data solely for the purpose of providing the agreed services and in accordance with our data processing agreement.

Payment and Subscription Terms

If you subscribe to our paid services:

• Fees are charged in advance on a monthly or annual basis as specified in your service agreement
• All fees are non-refundable except as required by law
• We may change our fees with 30 days' written notice
• Failure to pay fees may result in suspension or termination of services
• You are responsible for all taxes associated with your use of our services

Limitation of Liability

To the maximum extent permitted by law, cyberhubvexison Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to cyberhubvexison in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. cyberhubvexison disclaims all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the services will be uninterrupted or error-free
• Warranties regarding the accuracy or completeness of analytics data
• Warranties that the services will meet your specific business requirements

Indemnification

You agree to indemnify, defend, and hold harmless cyberhubvexison Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our services or violation of these Terms.

Termination

Either party may terminate the service agreement at any time with written notice. cyberhubvexison may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms.

Upon termination:

• Your right to use the services will cease immediately
• You must cease all use of our software and return any confidential information
• We will provide you with your data in a standard format upon request
• Provisions that by their nature should survive termination shall survive

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer residing in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

Changes to Terms

cyberhubvexison reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "last updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and cyberhubvexison regarding the use of our services and supersede all prior agreements and understandings.
